Putting Together Your Appeal For Reduction of Sentence

If you’re facing federal prison time and approaching the sentencing phase, filing a motion for sentence reduction, or working on a clemency packet, what should you include in letters to the judge? Or, alternatively, the President of the United States, or Pardon Czar Alice Marie Johnson, or U.S. Pardon Attorney Ed Martin Jr.?

Most will immediately think of close family members, like your wife, husband, mother, father, grandparents. And, these people do make sense – but the people to whom you are appealing already know your family will say you are the greatest person in the world. Even in the most horrendous moments in American history, such as the mass shooting in Columbine, Colorado or Parkland, Florida, family members still had positive things to say about the kids that perpetrated these acts.

These are not the voices that will move the needle. Judges and pardon attorneys need to hear how any form of early release will not harm the community, but also benefit the community at large. Their primary focus is to keep the community safe. You want members of the clergy, professionals, doctors, lawyers, and/or, if possible, members of law enforcement.

You have to dig deep into your past and identify any person who may be an asset – those who can vouch for your moments of good character, as well as describe your positive contributions to the world without using family as a motivating factor.
