So, What’s the Deal?

Can the First Step Act, or FSA, get an inmate in federal prison under a mandatory minimum?

Yes.

For instance, if you got a mandatory minimum on a drug conspiracy for 10 years without a firearm or a leadership role, you would be fully FSA eligible. You will also benefit from additional community confinement under the Second Chance Act.

You may also be eligible for a time reduction of one year by completing RDAP, the Residential Drug Abuse Program.

Given all of those benefits, you would be looking at an approximate five year prison term before being moved to halfway house or home confinement.

Under the newest guidance, mandatory minimums are eligible to earn and receive benefits from the First Step Act, Second Chance Act, and RDAP attendance as long as there’s no firearm.
