If Your Loved One Is Being Held Past Their Conditional Release Date, Their Are Options
Over a week ago, new guidance was issued to inmates in federal prison, prison staff, and the public at large on BOP.gov.
BOP director Billy Marshall issued guidance that cleared the air around a massive question: First Step Act and Second Chance Act community confinement benefits ARE to be stacked consecutively, and FTCs (Federal Time Credits) from the FSA should be calculated from the total sentence and front-loaded for a projected release date.
Unfortunately, we’re still receiving messages from all over the country that prisons like Montgomery FPC are still refusing to honor this new guidance.
So, what can you do if your loved one is past their conditional release date?
By going to Federalprisontips.com/conditional you can learn about your options with a 2241 motion, which can be used to take the BOP to task regarding the director’s new guidance, and hopefully get your inmate out sooner than later.
Federal Prison Tips and the Legal Advocacy Center can also advocate for you to the RRM to try to get your inmate out on their conditional release date, or find out why they’ve been kept past this date.
Enough is enough. Of all institutions, prisons should be ones following the law. People do not deserve to be in prison past their conditional release date as long as they qualify.
