Don’t Let Your Lawyer Make You Think You’ll Skip Federal Prison Time

Many people facing federal prison either don’t want to come to grips with the fact that they’re going to prison or their lawyers are lying about going to prison.

Sunshine And Rainbows Don’t Accomplish Anything

We recently had a consulting call from an executive who was facing five to seven years in federal prison for a crime that resulted in an actual loss of over $1 million.

In asking for our opinion, he mentioned that his attorney told him they are hopeful for home confinement or probation.

Here’s the hard truth: this is a very, very unrealistic expectation.

This person will likely get the five to seven years recommended by the U.S. Attorney and the U.S. Sentencing Guidelines. Judges rarely depart from guideline ranges.

It doesn’t matter what lawyer you have or who’s giving you high hopes – when we’re talking about crimes in this range, escaping serving some portion of time in federal prison is simply a pipe dream in 99% of cases.

Sometimes people don’t like it when we tell you the truth, but we aren’t here to sugarcoat the facts.

If you’re facing federal prison time for a white collar offense and you’re curious about what you’re facing, call our team at 407-434-0175 during business hours. We will send you the basic economic offense guidelines as set in the United States Sentencing Guidelines.

Now, unless you have a firearm charge or some other disqualifying offense, you’ll most likely get benefits under the First Step Act (FSA). This puts you closer to serving 52% of your total sentence adjudicated at sentencing.
