Many Believe Judges Are Another Cog In The Machine, But The Government Doesn’t Always Win
The judge has the final say in anything you bring to court. Whether that’s a 2241, 2255, compassionate release motion, or any kind of appeal. People who have been burned by jailhouse lawyers will quickly remind you of that.
But, although many feel the deck is always stacked against them when it comes to fighting for their rights in court, it’s important to remember that the judge does not automatically rule with the government or the BOP in every case.
There are innumerable cases in which the court did rule in favor of the defendant or the petitioner. Federal district courts are well aware of this fact, and countless legal precedents are in place as a result of these rulings.
The First Step Act (FSA) was implemented almost seven years ago come December 21st, and the Second Chance Act (SCA) was implemented 18 years ago in 2008.
We’ve helped 409 inmates in federal prison with FSA and SCA issues. There’s also the Legal Advocacy Center, or even Freedom Fighters PC who help inmates with similar issues every day. If you’re up to the task, you can fight for your rights yourself.
Of course, if you are tackling a court case yourself, be sure to have somebody on the outside who can monitor PACER and/or your docket do you never miss a deadline.
The most important thing is to do something. Anything. Don’t stay in prison past the date that you earned.
