New BOP Director Billy Marshall updated the BOP programming statement on clemency and commutation of sentence, Programming Statement PS 1330.15. This comes on the heels of the widely expected clemencies in the coming months.
As the world knows Former President Biden commuted the sentences of over 6500 individuals before the end of his term. As we also know President Trump is not one to be outdone by anyone, especially Biden. The number of clemencies expected from the Trump administration before the end of the term has been touted unofficially as 10,000 which of course makes sense with Biden doing 6500.
The clemencies for 2025 are expected to begin enmasse between July 20, 2025 and August 15, 2025.
The new guidance on commutation of sentence explains some key points:
– All sentenced inmates have access to the pardon attorney
– Case Management must submit clemency/commutation applications for any sentenced inmate that wants to even if they feel they don’t qualify
– Case management and the BOP must supply any information requested by pardon office
Some inmates in Federal Prison have been led to believe by their case managers that only the BOP can file clemency petitions which is blatantly false. In fact this guidance from the bop website clearly states that if an inmate chooses not to go through their case manager or the BOP does not do it for them they have the right, and can submit it themselves saying:
“If email is not available, petitions
may be mailed to the Office of the Pardon Attorney, U.S. Department of Justice, 950 Pennsylvania Avenue,
Washington, D.C. 20530″

One important fact noted in the official guide is that undocumented inmates can apply for clemency/commutation and if granted it would “hasten the process” of deportation, in other words you’d return to your country of origin faster.
Why Use A Third Party For Clemency Petitions

Other than having a professional long form version, think about when applying for a job, the pardon attorney’s office is going to receive over 7,000 “fill in the blank” applications, many chicken scatch and hard to read, many with incomplete sentences and incomplete information, easy to pass over.
