FIrst Step Act Allows for “years and years” of RRC according to BOP Director Colette Peters (it’s in the above video).

The First Step Act of 2018 is the first significant form of Prison Reform legislation in over three decades. The FSA allows for eligible inmates in federal custody to earn “earned time credits” against their sentence, or extra RRC (halfway house or home confinement) by participating in Evidence Based Recidivism Reducing Programs and other Productive Activities.

The rate at which in inmate earns those credits is determined by their PATTERN score which is their likelihood of recidivism, or coming back to prison. The goal of the First Step Act is to reduce recidivism.

Inmates with a low or minimum PATTERN score, earn 15 days off their sentence or towards RRC for every 30 days they participate in those EBRR’s or PAs. Inmates with medium or high recidivism scores earn at a rate of 10 days for every 30 that they participate in those EBRR’s or PAs. However, inmates with medium or high recidivism (PATTERN) scores, must wait until they reach the low or minimum score, to redeem those credits. But they are earning them.

The first 365 days of credit are redeemed against the inmates actual sentence, meaning they will leave BOP custody for supervised release, up to a year early, as long as they have a term of supervised release to follow. All of the additional earned credits, per the language of the law, and the director in the above video, go to RRC.

What is RRC?

RRC is Residential Re-Entry Center but in this case counts as either halfway house or home confinement. For many of our viewers and clients who are on pre-trial home confinement, it becomes easier for them to get on post-sentence home confinement as the home has already been approved (provided they are going back to the same home).

The Director has made it clear that inmates can now earn “years and years ” of RRC. We’ve had clients receive an enormous amount of RRC. We had one client in Yazzoo get 36 months of RRC while another at Yazzoo received 24 months. We have two that received 18 months of RRC at FPC Montgomery. So it is very possible.
