What Can A 2241 Motion Do?
Habeas Corpus is a Latin term that means “you have the body.” This motion allows inmates in federal prison to challenge the legality of their confinement based on the conditions or other elements.
If an inmate is being held past their conditional release date as per their First Step Act and/or Second Chance Act benefits, this is when a Habeas Corpus motion should be filed.
Here are some other popular reasons to bring a Habeas Corpus motion before a judge:
- When an inmate is being incarcerated more than 500 miles from home.
- To appeal a shot which is depriving the inmate of good time or other aspects of their quality of life.
- When an inmate is denied Halfway House after federal prison for opaque reasons.
- If an undocumented inmate is told they can not be given First Step Act credit without a final order of deportation. Usually, BOP employees will conflate this with a detainee, which is not the same thing.
- Some other constitutional right is being violated through the condition or means of incarceration.
